1. Acceptance of Terms

These Terms of Use govern your access to and use of the Bot4Trade automated trading software service ("Service") provided by Bot4Trade GmbH, an Austria-based company ("Bot4Trade", "we", or "us"). By accessing or using the Service (including any website, application or documentation we provide), you agree to be bound by these Terms and our Privacy Policy. You affirm that you are of legal age and have authority to accept these Terms. If you do not agree, you must not use the Service.

2. Description of Service

Bot4Trade provides a fully automated AI-powered crypto trading bot as a software-as-a-service (SaaS) accessed via our website. The Service connects through APIs to your accounts on supported crypto exchanges (currently BitMart, with Binance support coming later) to execute trades on your behalf according to the strategy parameters you set. You retain full control and custody of your exchange account and funds at all times – Bot4Trade does not hold or control any user funds or assets. Our Service allows you to configure and run automated trading strategies, but Bot4Trade never transfers, invests, or manages your funds; all asset movements occur directly between your accounts on the exchanges. Bot4Trade may update or improve the Service over time, and may release new versions or features (for example, a mobile app planned for 2026) without notice.

3. Subscription and Fees

Use of the Service requires a paid monthly subscription (currently €200/user) charged via PayPal, Stripe or supported cryptocurrency payments. All fees are non-refundable except as required by law. Your subscription will auto-renew monthly unless cancelled, and you authorize Bot4Trade (and its payment processors) to charge the applicable fee until cancellation. You are responsible for any taxes or exchange fees related to the Service. Bot4Trade may change pricing or payment methods upon reasonable notice.

4. User Obligations; Account Security

You agree to (a) provide accurate registration and account information (including a valid email) and promptly update it as needed; (b) keep your account credentials secure; and (c) monitor and secure your exchange API connections. You are solely responsible for configuring all trading parameters, risk limits and strategies in the bot. Bot4Trade is not liable for trades executed under your account or for unauthorized access to your accounts, and you must allocate sufficient funds in your exchange account for all trades you authorize.

5. Risk Acknowledgment and Disclaimers

Cryptocurrency trading is highly volatile and risky. You acknowledge that trading with the bot may result in significant losses or total loss of the assets in your account.

Bot4Trade provides the software on an execution-only basis: we do not provide investment advice, recommendations, or financial services. We make no representations or guarantees about the profitability, outcomes, or suitability of any trading strategy. You alone decide whether, when and how to trade. You warrant that you have sufficient financial knowledge and experience to understand these risks and to make your own independent decisions. If you do not understand these risks, you should not use the Service.

By using the Service you accept all risks of trading: Bot4Trade is not responsible for the outcomes of any trades you execute. The Service is provided "as is" and "as available," without any warranty or guarantee of accuracy, availability or performance. Bot4Trade expressly disclaims all warranties, whether express or implied, including warranties of fitness for a particular purpose, merchantability or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, secure or timely. You agree that you use the Service at your own risk, and Bot4Trade will have no liability for losses or damages resulting from your use of the bot or any trading decisions you make.

6. No Financial Advice; Non-Control of Funds

The Service is a software tool only and is not a financial advisor or broker. Under no circumstances should Bot4Trade be considered your financial or investment advisor. All orders are placed directly on the exchange under your account; Bot4Trade has no control over your funds and does not custody or move assets on your behalf. We do not review or control any trading decisions you make, and we are not responsible for your gains or losses. Any discussion of trading strategy or market conditions is for informational purposes only. You agree not to rely on Bot4Trade for investment advice or guaranteed returns.

7. Intellectual Property; License

Bot4Trade and its licensors retain all ownership of the Service, including all software, algorithms and content. Bot4Trade grants you a limited, non-exclusive, non-sublicensable, non-transferable license to use the software for personal trading purposes subject to these Terms. You may not modify, reverse-engineer, reproduce or redistribute the Service or any component, except as expressly permitted.

8. Restrictions and Prohibited Conduct

You may not use the Service for any unlawful or abusive purpose. You agree not to interfere with or disrupt the Service or engage in trading activities that constitute market manipulation. You must comply with all applicable laws in your jurisdiction. Bot4Trade reserves the right to suspend or terminate any account engaged in suspicious or illegal activity, or that violates these Terms.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what personal data we collect and how we process it. By using the Service you consent to our collection and use of data as described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law, Bot4Trade and its officers, affiliates and service providers will not be liable for any indirect, incidental, special, punitive or consequential losses (including lost profits or damages) arising from or related to these Terms or the Service. Our total liability to you for any claims will not exceed the total fees you have paid to Bot4Trade in the last twelve months. Some jurisdictions do not allow certain disclaimers or exclusions, so the foregoing limitations may not apply fully to you; in such cases, Bot4Trade's liability is limited to the maximum extent allowed by law.

11. Indemnification

You agree to indemnify and hold Bot4Trade (and its officers, employees and partners) harmless from any claims, losses, damages, liabilities or expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or infringement of any rights by your actions.

12. Updates and Termination

We may modify or update these Terms at any time; continued use of the Service signifies your acceptance of any changes. Bot4Trade may suspend or terminate the Service (or your access) at any time for any reason, including non-payment or violation of these Terms, without liability. Upon termination, all licenses granted by us will end.

13. Governing Law; Dispute Resolution

These Terms are governed by Austrian law. Any dispute arising hereunder will be resolved in the Austrian courts of competent jurisdiction.

14. Entire Agreement

These Terms (together with the Privacy Policy and any documents expressly incorporated by reference) constitute the entire agreement between you and Bot4Trade regarding the Service.
